Executive interference in the Judiciary will eradicate Malaysia's remaining whistleblowers

All Malaysians have deep, vested, and generations-long interest in the independence of the judicial branch.

The Tiada.Guru Campaign of MOE whistleblowers is alarmed at the Federal Government’s failure to institute plain and simple law reforms to safeguard judicial independence.

Members of Parliament must move immediately to remove the Prime Minister’s powers to nominate members of the Judicial Appointments Commission. Tiada.Guru supports the Malaysian Bar’s Walk to Safeguard Judicial Independence on 14 July 2025. Tiada.Guru also supports the recommendation of the Conference of Rulers to remove the Prime Minister’s appointment powers under the Judicial Appointments Commission on 14 November 2022.

Whistleblowers are nothing without an independent judiciary. If the Executive Branch further betrays whistleblowers and the independence of the judiciary, the rights of all Malaysians are at risk in perpetuity.

All Malaysians have deep, vested, and generations-long interest in the independence of the judicial branch. Whistleblower teachers, like Cikgu Nurhaizah, will be placed in extreme risk if Parliament fails to remove the Prime Minister’s “legal interference” into the Judicial Appointments Commission.

We remind Sabahans that an independent High Court declared that the Constitutional rights of young Sabahans were violated by the Director General of Education, the Minister of Education, and the Federal Government in the 2023 landmark judgment Rusiah Sabdarin & Ors v. Mohd Jainal Jamran & Ors [2023] 8 CLJ 603 [HC].

Whistleblowers plainly recognize judicial interference as dangerous acceleration by the Madani Government to threaten, demonize, and eventually eradicate whistleblowers in Court. No whistleblower will ever feel safe to testify in Court if the Executive Branch is proven to have interfered in any way in the Judicial Branch.

Tiada.Guru previously highlighted the importance of judicial independence for Sabahans in this brief Instagram statement on 29 June 2025.
